Kayak Pools – Terms and Conditions

Welcome to Kayak Pools! These Terms and Conditions ("Terms") apply to all sales, installations, promotions, and services provided by Swim TexSun, an authorized independent dealer of Kayak Pools.

By purchasing a pool or entering into a service agreement with us, you agree to the following terms:

1. Product and Installation

• All  pools sold are genuine Kayak® brand pools, featuring a premium aluminum  wall system and safety-first design.
• Installation  services are provided by trained professionals, either employed by or contracted through Swim TexSun Pools, Inc. Installation timelines are      estimated and may vary due to weather, or unforeseen site conditions.

2. Pricing and Payment

• All  pricing is subject to change until a contract is signed, and a deposit is      received.
• Final payment is due upon completion of the installation, unless financing has been arranged.
• The accepted payment methods include credit cards, certified check, personal check or approved financing through our lending partners.

3. Warranties

• Kayak®Pools come with a 30-year limited manufacturer’s warranty.
• Warranties do not cover damage caused by misuse, neglect, acts of nature, or improper maintenance.
• Installation workmanship may carry a separate limited warranty; please refer to your contract for details.

4. Promotions

• Promotional offers are subject to availability and may change without notice.
• Promotional offers cannot be combined unless explicitly stated.

5. Cancellations and Refunds

• Orders may be cancelled within 3 business days of signing the contract for a full refund of the deposit, in accordance with federal and state cooling-off laws.
• Deposits are not refundable after the 3 days right to cancel.
• Refund  requests must be submitted in writing to swimtexsun@earthlink.net

6. Site Conditions and Customer Responsibilities

• The customer agrees to disclose any underground utilities or obstructions prior to pool installation. 
• Swim TexSun is not responsible for damage to unmarked underground      structures or landscaping unless caused by negligence.

7. Limitation of Liability

• In no event shall Swim TexSun Inc. be liable for indirect, incidental, or      consequential damage arising from the use or inability to use the pool or      related products.
• Liability is limited to the amount paid by the customer for the product or service in question.
